Check out this ToS from Wind Mobile

So I happened to see a new app today by Wind Mobile. It’s called “Facebook Cover Photo Maker” and does exactly as it implies. It is a simple(so they say), and “funnest” *cough cough* photo editing app on Android they claim.

That’s all good and dandy, and could be useful, if you’re one of those people that change your cover photo as often as your underwear, but nonetheless, I downloaded it to check it out of course. As soon as you open the app, you are prompted to accept the ToS, which like most people, I have no reason to read normally, but this time however, I decided to check it out, and boy was I surprised, and glad I didn’t use the app yet!

As it turns out, Wind Mobile has included in the very first addendum that you grant them permission to “to us and our successors and assigns, of a perpetual, worldwide, irrevocable, non-exclusive licence, without compensation, reimbursement or any other payment, to publish, copy, perform, communicate, distribute, display, create derivative works, sublicence, translate, adapt and otherwise use the Submissions without restriction and for any purpose whatsoever, whether commercial or otherwise;”

Basically, any image you upload through the app as your Facebook cover photo goes through their own servers first, where it is duplicated, and then they have permission to edit it, translate it, licence it to another company, and/or sell your photos, to be used for advertisements, testimonials, etc., without paying or reimbursing the user who uploaded the photo.

So, what I’m guessing is that Wind is hoping that they have enough people upload photos through this app, so that they don’t have to pay for their own photographers and designers. Pretty slick, of them, but at the same time, pretty low.

Facebook Changes

I’ve been thinking a lot about Facebook and everyone complaining about it’s changes and such, and I’m pretty sure my Dad hit it right on the head of the nail.

Facebook can do whatever it likes.

I can’t believe the amount of people complaining when the new timeline style came out, and you still are. Do you realize that Facebook could just shut down and you’d have nothing to say against it? Facebook is a service that is still owned, it is not a public utility, or a right to use it. If it changes, it’s usually for the better of the site, and I’m sure they’re not doing it to piss you off.

Just remember, you do have a choice NOT to use Facebook if they way they run their own service bugs you.
